Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Eric Clymer, an individual doing business as Send Remy ("Send Remy," "we," "us," "our") governing your use of the Remy mobile application (the "App") and any related services we offer (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that:

• You are 18 or older;
• You have the legal capacity to enter into these Terms in your jurisdiction;
• You have never been convicted of a felony involving violence or a sexual offense;
• You are not a registered sex offender;
• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country;
• You are not on any U.S. Government list of prohibited or restricted parties.

The Service is intended for personal, non-commercial use only.

2. Your Account

You can create an account using Sign in with Apple, Sign in with Google, or — if we provide you credentials — email and password. You are responsible for safeguarding your sign-in credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@sendremy.com if you become aware of any unauthorized use of your account.

You may delete your account at any time from Profile → ⚙︎ → Account → Delete Account. Deletion is permanent and immediate: your profile, photos, messages, persona, agent conversations, and all associated data are purged from our systems. We may retain a minimal record solely to honor block, ban, or legal-hold obligations, as described in our Privacy Policy.

3. Description of the Service

Remy is an "agent-first" dating service. Each user has an AI assistant ("Remy") that holds a brief, compatibility-focused conversation with another user's Remy before the two humans ever message each other directly. Both users then read a transcript and a debrief of the conversation, and each independently decides whether to match. A direct human-to-human chat is unlocked only when both sides choose to match.

What Remy does and does not do:

• Remy is an AI. It is not a human, not a licensed counselor or matchmaker, and not capable of representing you for any purpose other than conducting the pre-match compatibility conversation defined within the Service.
• Remy never makes commitments on your behalf. It cannot agree to meet someone, make promises, schedule events, exchange contact information outside the App, or take any action that binds you. The conversation Remy holds is exploratory only.
• You always retain control. You choose whom to send Remy to, you decide whether to match after reading the debrief, and you write all messages in the post-match human chat. The AI does not speak for you after a match.
• You are still meeting real people. Compatibility scoring and AI-generated debriefs are aids to your decision; they are not guarantees, predictions, or endorsements. Use your own judgment.

4. User Content

"User Content" means everything you submit to the Service: your name, photos, age, city, voice intro, persona answers, agent notes, chat messages, reports, and any other content you upload or generate.

Your ownership. You retain ownership of your User Content.

License to us. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, transmit, and process your User Content solely to operate, improve, and provide the Service. This license ends when you delete the content or close your account, except (a) for content shared with another user (which they may retain in their own chat history), and (b) for backups and logs that age out in the normal course of operations.

AI processing. Your User Content — including your voice intro transcript, persona answers, agent notes, and chat messages — may be sent to third-party large language model providers (such as Anthropic) for processing necessary to operate the Service. Voice audio is transcribed on-device when possible; only the resulting text is transmitted off-device. We never sell your User Content to advertisers.

Moderation. We use automated content moderation to detect prohibited content (described in §5). Your content may be reviewed by automated systems and, where necessary, by human moderators. Content that violates these Terms may be removed without notice.

Photos. You represent and warrant that the photos you upload depict you, that you have the legal right to use and share each photo, and that no photo contains nudity, minors, weapons, drugs, contact information, watermarks, or content that violates §5.

5. Prohibited Conduct

You agree not to:

• Use the Service if you are under 18, or attempt to use the Service to interact with anyone you know or suspect to be under 18;
• Impersonate any person, misrepresent your identity, age, or affiliation, or use fake or non-self photos;
• Create more than one account, or create an account if we've previously terminated yours;
• Harass, threaten, stalk, bully, defame, or intimidate any user, or engage in conduct that is hateful, racist, homophobic, transphobic, sexist, or otherwise discriminatory;
• Send or solicit sexually explicit content, nudity, or content involving minors;
• Promote violence, terrorism, self-harm, or any illegal activity;
• Solicit money, financial information, or financial favors from other users; engage in commercial solicitation, advertising, multi-level marketing, prostitution, escort services, or sex work;
• Send unsolicited communications, spam, chain messages, or bulk content;
• Share another user's private information (real name, address, phone, email, employer, photos) without their consent;
• Bypass, attempt to bypass, or interfere with any security feature, rate limit, content filter, moderation system, block, or report mechanism;
• Use bots, scrapers, automated agents, or other software to access the Service except as expressly permitted by us;
• Reverse-engineer, decompile, or attempt to derive the source code of the App;
• Use the Service for any purpose that is unlawful in your jurisdiction or ours;
• Encourage or facilitate any of the above by any other user.

We reserve the right to investigate and take any action we deem appropriate in response to violations, including content removal, account suspension, permanent termination, and reporting to law enforcement.

6. Block, Report, and Unmatch

Every people-facing surface in the App lets you Block a user, Report a user, and (for an active match) Unmatch a user. Reports are reviewed by our moderation team and may result in warnings, removed content, suspensions, or terminations. Blocks are bidirectional and prevent both sides from seeing each other in Discovery, sending each other messages, or being matched in the future. Unmatching ends a match for both users and removes the chat from both inboxes.

We do not discuss the outcome of individual reports with the reporter.

7. Subscriptions and One-Time Purchases

The Service offers the following in-app purchases through the Apple App Store:

7.1 Remy Plus (Auto-Renewable Subscription)

• Price: US$9.99 per month, or the local-currency equivalent.
• Duration: 1 month, automatically renewing.
• Benefits: Lifts your daily Remys cap to 50; expands your Discovery deck.
• Payment: Charged to your Apple ID at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews at the end of each one-month period at the then-current price, unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• How to cancel: Open the iOS Settings app → tap your Apple ID at the top → Subscriptions → Remy → Cancel Subscription. Cancellation takes effect at the end of the current paid period; you retain Remy Plus benefits until then.
• Free trials: Any free trial period is automatically converted to a paid subscription unless cancelled at least 24 hours before the trial ends.

7.2 7-Day Boost (Consumable)

• Price: US$4.99 per purchase.
• Benefits: Your profile is shown at the top of other users' Discovery decks for 7 days.
• Type: Consumable — expires after 7 days; you may purchase additional boosts.

7.3 Extra Cards (Consumable)

• Price: US$1.99 per purchase.
• Benefits: Adds 10 additional Discovery profiles to your deck today.
• Type: Consumable — resets at midnight UTC; you may purchase additional packs.

7.4 General

All purchases are processed by Apple. We never receive your full payment card information; we receive only a signed transaction record from Apple containing the product purchased, the transaction ID, and (for subscriptions) the expiration date.

Refunds for in-app purchases are handled by Apple under the Apple Media Services Terms (https://www.apple.com/legal/internet-services/itunes/). To request a refund, visit reportaproblem.apple.com. We do not control or issue App Store refunds.

We reserve the right to change prices, add new tiers, or discontinue products at any time. Existing subscriptions will continue at the price you originally agreed to until your next renewal, at which point any new price will apply if you have not cancelled.

8. Apple-Specific Terms

The Service is licensed to you on a limited, non-transferable, non-exclusive basis solely to be used on iOS devices you own or control. This section is an addendum required by Apple for apps distributed via the App Store.

• Acknowledgment. These Terms are entered into between you and Send Remy only, not with Apple. Apple is not responsible for the Service or its content.
• Scope of License. Your license is limited to use of the App on Apple-branded devices that you own or control and as permitted by the Apple Media Services Terms.
• Maintenance and Support. Send Remy is solely responsible for any maintenance or support of the App. Apple has no obligation to provide such services.
• Warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Product Claims. Send Remy, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Intellectual Property Claims. In the event of any third-party claim that the App or your use of the App infringes that party's intellectual property rights, Send Remy (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal Compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

9. Intellectual Property

The Service, including all software, design, graphics, the Remy and Send Remy marks, the sendremy.com domain, and all related content (other than User Content) is owned by Send Remy and protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by these Terms or by us in writing.

You may not use our trademarks, logos, or trade dress without our prior written consent.

10. Privacy

Your privacy matters to us. Our Privacy Policy describes what data we collect, how we use it, when (if ever) we share it, and how you can exercise your privacy rights. By using the Service, you also agree to our Privacy Policy.

11. Termination

You may stop using the Service and delete your account at any time from Profile → ⚙︎ → Account → Delete Account.

We may suspend or terminate your account, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for us or another user, or for any other reason at our reasonable discretion. We may also discontinue the Service in whole or in part at any time. Upon termination, sections of these Terms that by their nature should survive — including §§4 (license back), 8, 9, 12, 13, 14, 15, and 18 — will survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content (including AI-generated content such as agent conversations, transcripts, or debriefs). We do not warrant that you will find a match, develop a relationship, or have any particular outcome from using the Service.

Other users are not our employees, agents, or vetted partners. We do not conduct background checks. We do not verify identities beyond what is required for account creation. Interactions with other users — whether through Remy, in chat, or in person — are at your own risk. Meet new people in public, share personal information cautiously, and trust your instincts.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEM HOLDINGS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in full. In such cases, our liability is limited to the maximum extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Send Remy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any third-party right, including any privacy, publicity, or intellectual-property right; or (e) your interactions with other users, whether online or in person.

15. Dispute Resolution; Governing Law

These Terms are governed by the laws of the State of [Your State], U.S.A., without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution first. Before filing any formal claim, you agree to contact us at contact@sendremy.com and attempt in good faith to resolve the dispute. Most disputes can be resolved without formal proceedings.

Venue. Any formal dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in [Your County], [Your State], and you consent to personal jurisdiction there.

Class action waiver. To the extent permitted by law, you and we each agree to bring claims only in your or our individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the App and update the Last Updated date above. Your continued use of the Service after the new Terms take effect constitutes your acceptance of the changes. If you do not agree, you must stop using the Service and delete your account.

17. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
• Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force.
• No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
• No third-party beneficiaries. Except as expressly stated for Apple in §8, there are no third-party beneficiaries to these Terms.
